1. Acceptance & Organization Tenancy

By creating an account, registering an organization, or accessing the Service, you agree to these Terms and our Privacy Policy. If you register on behalf of a construction firm, engineering contractor, or government agency, you warrant that you possess legal authority to bind that entity.

BillChecker operates as a multi-tenant platform. All projects, measurement sheets, line items, and abstracts belong exclusively to an Organization. Cross-tenant access is strictly segregated by application-enforced organizational identifiers.

2. User Roles & Access Rights

Access within each Organization is governed strictly by the following three supported roles:

  • OWNER: Holds full administrative control over the organization, manages member invitations and role assignments, oversees bill generation and dispatch, and possesses project authoring and deletion rights.
  • BILLER: Authorized to create and manage projects, enter measurement sheets, record dimensional line items, modify deduction entries, and dispatch completed bills to clients.
  • VIEWER: Granted read-only visibility into accessible projects, sheets, and generated summaries. Viewers cannot modify measurements or create records.

The Organization is vicariously liable for all actions conducted under accounts assigned to its tenant.

3. Offline Operation, Sync & Conflict Resolution

BillChecker is engineered to function in disconnected job sites. Project records, measurement sheets, and your local mutation outbox are stored on your device hardware using IndexedDB, with application shell bundles cached via Service Worker.

Notice on Local Persistence & Data Safety:

Modifications made offline reside solely in your local browser database until your device reconnects to the network and synchronizes with our servers. Clearing your browser cache, resetting origin data, operating in private/incognito mode, or suffering physical device loss before synchronization completes will cause irrecoverable loss of un-synced entries.

When concurrent offline modifications conflict with server state, BillChecker employs optimistic versioning. Detected conflicts are flagged to the user via an interactive conflict resolution dialog, allowing you to choose whether to keep your local revision or accept the remote state. Modifications are never silently superseded.

4. Calculation Engine & Engineering Disclaimer

BillChecker provides automated arithmetic routines, dimensional product calculations (Length × Breadth × Depth), and half-up rounding designed to support civil measurement norms such as the CPWD Works Manual and IS 1200 standards.

However, BillChecker is an automated calculation tool, not a licensed professional engineer:

  • The accuracy of generated quantities depends entirely on the accuracy of human inputs, deductions, and rate items entered into the platform.
  • The Service does not inspect physical job sites or certify that on-site execution matches recorded measurement sheets.
  • Statutory verification, contractual sign-off, and final disbursement certification remain the exclusive legal responsibility of the licensed Site Engineer, Quantity Surveyor, or Project Manager.

5. Account Security & Credentials

Users are required to maintain strong credentials (passwords with minimum 12 characters, hashed on our servers using Argon2id). You are responsible for safeguarding your credentials and restricting unauthorized access to your devices.

To prevent cross-user data exposure on shared field hardware, signing out prompts you to confirm whether pending offline data should be cleared or retained, and invalid sessions trigger client database cleansing once synchronization queues are settled.

6. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any local, national, or international civil construction regulations or laws.
  • Submit fraudulent, forged, or unauthorized measurement records or bills.
  • Probe, scan, or test the vulnerability of our systems or networks without authorization.
  • Attempt to reverse-engineer, decompile, or extract the source code of the backend services.
  • Interfere with or disrupt the integrity or performance of the Service or its data.

7. Proprietary Rights & Data Export

Your Organization retains complete ownership of all project measurements, client names, sheet entries, and rate abstracts inputted into BillChecker. We claim no intellectual property rights over customer project content.

You may export your measurement sheets to Microsoft Excel (XLSX) format and generate printable browser views at any time during active use.

8. Warranty Disclaimer ("AS IS")

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, AND NON-INFRINGEMENT. BILLCHECKER DOES NOT WARRANT THAT THE SERVICE WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT CALCULATIONS SATISFY SPECIFIC CONTRACTUAL OR STATUTORY AUDIT DISPUTES.

9. Indemnification

You agree to defend, indemnify, and hold harmless BillChecker Technologies, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the Service; (b) any construction billing disputes, subcontractor disputes, or liquidated damages between you and project principals; or (c) your breach of these Terms.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL BILLCHECKER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, PROJECT HANDOVER DELAYS, WORK STOPPAGES, OR LOSS OF DATA, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

BILLCHECKER'S TOTAL AGGREGATE LIABILITY ARISING UNDER OR RELATED TO THESE TERMS SHALL NOT EXCEED THE GREATER OF: (A) THE TOTAL FEES PAID BY YOUR ORGANIZATION TO BILLCHECKER IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM; OR (B) FIVE THOUSAND INDIAN RUPEES (INR 5,000).

11. Changes to Terms

We may update these Terms periodically to reflect product updates, regulatory requirements, or operational enhancements. When modifications occur, the revision version and date will be updated. For material changes, users will be provided notice through the application interface, and affirmative re-acknowledgment will be prompted upon sign-in before continuing use of the Service.

12. Termination & Workspace Closure

You may terminate your account at any time by contacting our support team. Upon written request by an Organization Owner, we will deactivate the tenant and queue cloud records for deletion following our 90-day operational audit window and statutory holding periods, with user registration and consent audit records preserved for the account lifetime as required under DPDP Act Section 6(10).

13. Force Majeure & Dispute Resolution

Neither party shall be liable for failure or delay in performing its obligations under these Terms due to causes beyond its reasonable control, including acts of God, natural disasters, telecommunications failures, utility outages, civil disturbances, or government actions (Force Majeure).

These Terms shall be governed by and construed in accordance with the laws of India. Any controversy or claim arising out of or relating to these Terms shall be settled by binding arbitration in New Delhi, India, under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed mutually or through judicial proceedings in New Delhi.

14. Miscellaneous & Entire Agreement

These Terms and the Privacy Policy constitute the entire agreement between you and BillChecker concerning the Service. If any provision is held invalid or unenforceable, that provision shall be enforced to the maximum extent permissible, and the remaining provisions shall remain in full force and effect.
